Overview
This privacy policy is meant to help you understand how Ideate, Inc. collects, uses, and protects the personal data we collect, and the limited circumstances in which we transfer data to our partners, and what they do with that data. For the purposes of this policy, personal data includes any information that can be used on its own or with other information to identify, contact, or locate an individual, or to identify an individual in context.
We only collect and use your data when: (1) you consent to our doing so; (2) we need to fulfill an obligation we have to you; (3) it is necessary for our legitimate interests in providing and offering the services available on our website; or (4) in limited situations where we are required to do so by law.
We need certain personal data, including your contact, shipping, and payment information to process orders you place. If you do not wish for us to collect this information, you will not be able to take advantage of the services on this website.
For any personal data collected outside the order-processing context or not otherwise necessary for a legitimate interest or legal compliance, we will ask for your consent before collecting. You can contact us
to request that we no longer collect such data or that we remove what we have collected.
1. What Personal Information Do We Collect, and When Do We Collect It?
Ordering and Registration:
When ordering or registering on our site, as appropriate, you may be asked to enter your name, email address, mailing address, phone number, credit card information, or other details about your job, industry, and software package to improve your experience. You may review and update the information you provide by contacting [email protected], and delete your account if need be. You need to provide this information in order for us to provide you with the services available on this website.
Software Trial Sign-Up: To sign up for a software trial, you will be required to enter your name, email address, telephone number, company name and country. This information may be transferred to our promotional and reseller partners for the limited purpose of a sales follow-up.
Software Activation Data:
We collect the device name and IP address along with the Revit user ID from those who are using our standalone and cloud network licenses. We do not collect this data for FlexLM network license users.
Ideate Automation Forge Data:
If the user chooses to log into Ideate Automation, then only the Revit user ID is collected. This information is used for the purposes of future authentication needed to synchronize (locally) the names of the hub/accounts, project and file names from the Autodesk Construction Cloud (ACC).
Email Marketing and Surveys:
You may opt-in to our email marketing. If you do, you may be asked to fill out a survey. For email marketing, we may ask you for your contact information, job title, and industry, to alert you to relevant updates in our services, events, trainings, and more. Our surveys may ask you for data including your name, contact information, job title, industry, and the software you use or the hardware on which it operates.
Contact Form: When you use the ‘Email Us’ form on our webpage to submit comments or questions we require that you submit your name, email, company, and country. We use this information only to respond to your comments or questions. We may also transfer the data you submit in the ‘Email Us’ form to our VAR partners for the limited purpose of a sales follow-up. By entering your data and clicking ‘SUBMIT’ you are consenting to collection and use of that data, as described.
Webinar Registration Form:
Our Ideate Software webinars are delivered via the GoToWebinar platform. When you register for our webinars, we will ask you for your name, email address, country, phone number, and company name. We may transfer the data you submit in this form to our promotional and retail partners for the limited purpose of a sales follow-up. We do not otherwise transfer, and our partners do not otherwise use, the data submitted in this form. By entering the data and clicking “Register” you are consenting to the collection and use of the data, as described.
In-Person Event Registration Form:
If you wish to attend one of our in-person events, you will be asked to provide your contact information including your email address, job title, name and your organization’s name. We use this information to facilitate the event and provide you with an acceptable service. We may also transfer the data you submit in this form to our promotional and retail partners for the limited purpose of a sales follow-up. We do not otherwise transfer, and our partners do not otherwise use, the data submitted in this form. By entering the data and registering for the event, you are consenting to the collection and use of the data, as described.
Industry Conferences and Exhibitions: When you visit our booth at industry conferences and exhibitions that we do not host and organize, we collect information from you with your explicit consent. The information we collect includes your name and company name, may include the software you use, and any other relevant data you share with us. We use this data to answer your inquiry, post-event. We may also transfer the information you share with us to our promotional and retail partners for the limited purpose of a sales follow-up. We do not otherwise transfer, and our partners do not otherwise use, the data you share with us at the event. By sharing your information with us at our booth, you are consenting to the collection and use of the data, as described.
Automated Information: When you access our website we automatically receive and record information from your browser. The information can include your IP address or unique device identifier, cookies, and data about which pages you visit. This information helps us operate and provide the services available on our website. It is collected automatically and stored in log files. We may combine this information from your browser or your mobile device with other information that we or our partners collect about you, including across devices. This information is used to prevent fraud, to keep our website and the services secure, and to analyze and understand how you and other visitors use our website.
Cookies are small files that a site or its service provider transfers to your computer's hard drive through your web browser (if you allow) that enable the site's or service provider's systems to recognize your browser and capture and remember certain information. We use cookies to:
- Track and process items in shopping carts;
- Understand and save user's preferences for future visits;

2. How Do We Use Your Information?

- We need to fulfill a contractual obligation we have to you;

Our engagement of service providers is often necessary for us to provide the products and services available on our website. We only engage third parties out of our legitimate interest in working with service providers to make our website and services better. 3. When Do We Transfer Your Data?

This includes that, where applicable, we will only transfer your data when such transfer is in accordance with our legal basis for collecting your data.
We will transfer your personal data to other countries only if and when permitted by our legal bases for collecting and using your personal data to begin with, and only to the countries we are permitted to do so by law. Please be aware that the privacy laws and standards in certain countries may differ from those in your country of residence.
We take steps to ensure that any personal data we transfer remains subject to appropriate security measures.
4. How Do We Protect Your Data?
Our website is scanned on a regular basis for security holes and known vulnerabilities to make your visit to our site as safe as possible:
- We use regular malware scanning;
- Your personal data is contained behind secured networks and is only accessible by a limited number of people with special access rights to such systems, and they are required to keep the information confidential;
- All sensitive/credit information you supply is encrypted via Secure Socket Layer technology; and
- All transactions are processed through a gateway provider and are not stored or processed on our servers
5. How Long Do We Keep Your Data?
We will retain your data only as long as necessary for the uses stated in this policy. You may contact us
to opt-out of email marketing or to close your account with us. After that, we would only keep data if and to the extent reasonably necessary to comply with our legal obligations (for example, to comply with applicable tax or revenue laws), resolve disputes, enforce agreements, and as otherwise described in this policy.
We may also retain log files for analytics purposes. These are generally only kept for a short time, unless required for safety, to make improvements, or to comply with requirements as stated above.
6. Your Choice and Control
You may request that we update any personal data we have kept by contacting us.
Depending on your location, you may have certain other right with respect to your personal data, such as:
- Access and portability (including that you may request a copy of the data we have collected);
- Corrections (including that you may request we correct any personal data we have collected);
- Deletions (including that you may request we delete the personal data we have collected, except information we are required to retain); and
- Withdrawals of consent or objections to processing (including that you may, in certain circumstances, ask that we stop processing your personal information, with some exceptions).
You may also opt-out of email marketing at any time.
7. Changes to this Privacy Policy
We may update the terms of this Privacy Policy as necessary to comply with additional regulations or to meet new business demands. We will send notices by email and post notices on our website if we update this Privacy Policy.
8. Third-Party Links
Occasionally, at our discretion, we may include or offer third-party products or services on our website. These third-party sites have separate and independent privacy policies. We have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.
9. Google
Google's advertising requirements are described in Google's advertising terms. They are put in place to provide a positive experience for users.
We have implemented the following:
- Google Display Network Impression Reporting; and
- Demographics and Interests Reporting.
We, along with third-party vendors such as Google, use first-party cookies (such as the Google Analytics cookies) and third-party cookies (such as the DoubleClick cookie) or other third-party identifiers to compile data regarding user interactions with ad impressions and other ad service functions as they relate to our website.
You can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt out by visiting the Network Advertising initiative opt-out page or permanently using the Google Analytics Opt-Out Browser add-on.
10. California Online Privacy Protection Act
CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law's reach stretches well beyond California to require a person or company in the United States (and conceivably the world) that operates websites collecting Personally Identifiable Information from California consumers to post a conspicuous privacy policy on its website stating exactly how the information is being collected, with whom it is being shared, and to comply with this policy.
In accordance with CalOPPA, we agree to the following:
- Users can visit our site anonymously;
- A link to this privacy policy is on all our website pages. It includes the word 'Privacy' and can be easily be found on any page;
- We honor do-not-track (DNT) signals and do not track, plant cookies, or use advertising when a DNT browser mechanism is in place; and
- We allow third-party behavioral tracking.
11. COPPA (Children Online Privacy Protection Act)
When it comes to the collection of personal information from children under 13, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation's consumer protection agency, enforces the COPPA rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online.
We do not market to children under 13, and we do not intentionally collect the personal data of children under 13 years old. Our Terms of Use require that all users of our website be: (a) at least 18 years of age; or (b) between 13 and 18 years of age with the direct supervision of someone at least 18 years of age. You may not use our website or the services available through them if you are under the age of 13. If you are the supervisor of a user who is between the ages of 13 and 18, you are responsible for their actions while using our website or the services provided through them.
12. Fair Information Practices
The Fair Information Practices Principles form the backbone of privacy law in the United States, and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.
In accordance with the Fair Information Practices we will notify the users via email within 7 business days should a data breach occur, unless other applicable requires earlier notice.
We also agree to the individual redress principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or a government agency to investigate and/or prosecute non-compliance by data processors.
13. CAN-SPAM Act
The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.
We collect your email address to:
- Send information, and respond to inquiries and/or other requests or questions;
- Process orders and send information and updates pertaining to orders;
- Send additional information related to your product and/or service; and
- Send marketing emails after the original transaction has occurred.
In accordance with CAN-SPAM, we agree to:
- NOT use false or misleading subjects or email addresses;
- Identify the message as an advertisement in some reasonable way;
- Include the physical address of our business or site headquarters;
- Monitor third-party email marketing services for compliance, if one is used;
- Honor opt-out/unsubscribe requests quickly; and
- Allow users to unsubscribe by using the link at the bottom of each email.
